F. Colin Durham Jr.

Biography

Colin Durham has over 30 years of courtroom experience diligently advocating for his clients. His primary area of practice is civil litigation, including employment law, construction, contract, commercial, and related areas of business litigation. He has tried numerous jury and bench trials on behalf of his clients. His employment practice primarily consists of representing management against claims in the substantive areas of race, sex, age, religion, accommodation/discrimination, national origin, and disability discrimination, retaliation, Wage & Hour claims, workers’ compensation retaliation claims, sex harassment, contract claims and various employment-related torts. Colin’s experience in appellate work includes having represented clients before The Texas Supreme Court, and several of the Texas District Courts of Appeal and Federal Courts of Appeal.

Colin regularly counsels human resource professionals and in-house counsel in all aspects of employment law, including discipline and discharge, leave and accommodation administration, handbook and policy review, contract negotiation and drafting, and the handling of administrative matters such as EEOC and TWC charges and claims before state and administrative agencies.

Colin is admitted to practice in the state courts of Texas and the U.S. District Court for the Northern and Eastern Districts of Texas.

Representative Experience

  • Successfully prosecuted an appeal before the Texas Supreme Court on behalf of a land developer against a purchaser who had breached his personal guaranty agreement for the purchase of the development
  • Won a jury verdict on behalf of a board of directors from claims made by a corporate executive in a discrimination and tortious interference case and successfully defended the verdict upon appeal
  • Successfully prosecuted claims on behalf of numerous corporate clients against former employees for breach of covenants not to compete and misappropriation of trade secrets
