Anders W. Lindberg

Biography

Anders Lindberg serves as the firm’s Chair of the Litigation Department. He is also the team leader of the Long-Term Care Team. Clients rely on Anders for his extensive experience supervising and managing high-value, complex civil and commercial litigation. This includes bet-the-company litigation and litigation arising from catastrophic accidents. He also focuses his practice in the areas of professional liability defense, employment litigation, and general litigation.

For over twenty years, he has successfully represented large health systems and international manufacturers in complex employment litigation involving wrongful termination, alleged workplace discrimination and other human rights violations, and harassment. He has successfully tried these and other cases in both state and federal courts, as well as before the Human Rights Commission.

Additionally, he has handled numerous medical professional liability cases and complex business litigation for several local businesses as well as international corporations.

Representative Experience

  • Won jury verdicts on behalf of physicians and other medical care providers in medical malpractice cases involving permanent injuries and death
  • Won a jury verdict on behalf of one of the largest banks in the world in a claim alleging fraudulent misrepresentation, aiding and abetting, and violations of the Blue Sky Act
  • Lead counsel in litigation involving a $22 million construction project involving numerous parties
  • Represented several of West Virginia’s largest employers in matters involving employment matters. Clients include large health systems and automotive manufacturers
  • Won jury verdicts and obtained summary judgments in employment cases on behalf of large hospitals and large manufacturers
  • Successfully defended numerous cases of employment discrimination before the Human Rights Commission on behalf of large hospitals and large manufacturers
  • Represented numerous long-term care facilities and assisted living facilities in over 100 separate wrongful death actions brought by families of deceased former residents
  • Obtained summary judgment in numerous deliberate intent actions on behalf of large manufacturers, a major chemical company, oil and gas companies, and retailers
  • Prosecuted and defended over 30 bench trials
  • Obtained summary judgments on behalf of numerous real estate companies and numerous realtors in alleged breach of fiduciary duty to purchasers of real estate and alleged realtor malpractice
  • Won an arbitration proceeding on behalf of a nursing home
  • Successfully defended long-term care facilities in arbitration proceedings involving alleged professional malpractice and employment discrimination
  • Defended long-term care facilities in COVID-19 litigation in State, Federal District Court, and Appellate Courts involving claims of immunity under the PREP ACT
