Scott M. Campbell

Biography

Scott focuses his practice in energy and natural resources litigation in both state and federal courts. He has experience defending clients before the Colorado Oil and Gas Conservation Commission on adjudicative and rulemaking proceedings, the Wyoming Oil and Gas Conservation Commission on adjudicative proceedings, and the United States Department of the Interior, Interior Board of Land Appeals, on various permitting, leasing, environmental and unit issues. He also counsels clients in appellate, bankruptcy, commercial, and probate matters.

  • Successfully litigated complex rule against perpetuities issue allegedly affecting area of mutual interest provision and the validity of overriding royalty interests in excess of $200 million.   • Successfully litigated a multiple horizontal well, multi-million dollar, mineral trespass action in federal court to jury verdict on liability for bad faith trespass, settled before the damages phase of the trial. Associated complex and overlapping Colorado Oil and Gas Conservation Commission spacing and statutory pooling issues. Synergy Res. Corp. v. Briller, Inc., Civil Action No 15-cv-01337-RBJ, United States District Court for the District of Colorado
  • Obtained ruling from Colorado Oil and Gas Conservation Commission that overriding royalties, on non-consenting working interests which have been statutorily pooled, are not required to be paid until after payout
