Biography

Gene Smallwood, Jr. now focuses his practice in the areas of professional liability and business law. He has over 40 years of experience successfully representing clients in litigation involving real property, corporate law, mining law, workers' compensation, administrative law, health care law, state and federal appellate practice and personal injury law, many such cases resulted in verdicts or settlements in excess of $1,000.000.00.

In 2018, Judge Smallwood was appointed to the Kentucky Court of Appeals, 7th District, Division 2, by Governor Matt Bevin. Prior to his appointment, Judge Smallwood had served as Assistant Commonwealth Attorney. Previously, he has also been appointed as Special Justice to the Supreme Court of Kentucky.

Key Experience

Represented and served large, privately owned coal companies in all aspects of their operation including negotiations and preparing documents for acquisition of and/or construction of coal preparation facilities, overseeing state and federal regulation defending all litigation including contract, lease and property disputes and defense of workers' compensation claims

Managed a case involving the faulty construction of a coal preparation facility, filed jointly in state and federal court, to the U.S. Supreme Court resulting, after oral argument before the Court, in a favorable outcome keeping the matter in state court while staying the federal action and eventually ending in a substantial settlement
