Biography

John “Andy” Hess takes pride in solving problems for his clients.  Whether an issue is in the pre-trial stage, active litigation stage, or appellate stages, Andy truly enjoys analyzing complicated legal issues and coming up with pragmatic, but unique approaches to his clients’ issues.  He works every day to alleviate his clients’ worries about the litigation process by placing an emphasis on attention to detail, client service, availability, and open communication.  When litigation is required, Andy fights for his clients with hard work, determination, and toughness. 

Andy has a variety of experience protecting the interests of doctors, healthcare facilities, skilled nursing facilities, universities, insurance companies, commercial property owners, manufacturers, and individuals.  His practice mainly focuses on civil litigation that involves serious injury or death.  While personal injury cases make up the bulk of his practice, Andy also has experience with contract disputes, products liability actions, allegations related to civil rights violations, and appellate issues.

Andy regularly manages every aspect of complex litigation from pre-suit due diligence all the way through the discovery process.  Andy has trial experience in West Virginia state and federal courts, as well as appellate experience before the Supreme Court of Appeals of West Virginia, the United States Court of Appeals for the Fourth Circuit, and the Supreme Court of the United States.  When away from work, Andy loves to spend time with his beloved family and enjoys golfing, attending sporting events, and keeping tabs on the latest movies and shows.

Successfully defended NCAA Division 1 university’s athletic department and staff in matter alleging general negligence and athletic trainer medical negligence
Received successful outcome before the Fourth Circuit and United States Supreme Court in matter alleging LGBTQ sexual orientation discrimination, tortious interference, equal protection and due process civil rights violations, and defamation in favor of higher education institution and credentialed staff
Defended large regional hospital and employed physician in employment matter alleging sexual harassment
