Biography

Mitch Moore thrives on hard work and is known by his colleagues and clients as an effective communicator and problem solver. Clients appreciate that Mitch addresses their concerns and answers their questions honestly and objectively while helping them navigate the litigation process with an eye toward the most advantageous result. Mitch helps clients mitigate the immediate risk and guides them through best practices to prevent future disruptive and costly litigation.

Mitch represents insurance companies and their insureds in premises liability, commercial and general litigation, and transportation-related accidents. Mitch’s sweet spot is in medical malpractice and professional liability practices where he defends hospitals and their affiliated practices, and long-term care facilities.

Mitch’s approachability and focus on responsive client service endear him to his clients and colleagues.

Representative Experience

  • Represented long-term care and assisted living facilities in wrongful death and resident care litigation in West Virginia state courts
  • Won motions to dismiss for lack of personal jurisdiction for parent companies of nursing facilities
  • Defended multiple long-term care facilities in COVID-19 litigation involving claims of immunity under the PREP ACT
  • Lead trial counsel for multi-unit housing owner in contentious personal injury litigation, achieving verdict less than settlement demand
  • Successfully obtained Summary Judgment on behalf of West Virginia water company in a negligent property damage claim involving surface and property fixture damage
  • Represented obstetrician in an alleged birth injury case in West Virginia state court
  • Successfully obtained Summary Judgment on behalf of a large natural gas provider in a personal injury claim alleging carbon monoxide poisoning
  • Part of the defense team in various medical malpractice lawsuits involving improper pharmaceutical administration
  • Obtained dismissal on behalf of a state agency in a claim alleging breach of protected health information
  • Defended local water company in a claim alleging property damage due to water infiltration
  • Participated in the defense team for long-term care facilities in matters involving patient falls and pressure ulcers
  • Defended local hospital in a lawsuit alleging failure to administer stroke mitigation drug in an emergency room setting
